Prowler kicks in back door of house in middle of night. But homeowner has a gun — and puts an end to the break-in.

0

Police said a homeowner in Santa Clara, California, was awakened just before 2 a.m. Sunday by a man sneaking around in his backyard and also pounding on doors and windows, KTVU-TV reported.

Police said the suspect broke a window and then “forcibly kicked open a rear door,” the station said.

What happened next?

Thing is, though, the homeowner had prepared for just such an incident by exercising his Second Amendment rights.

And after the suspect kicked open the back door of the residence, the 51-year-old homeowner fired his gun “multiple” times and shot him, police told KTVU.

What happened to the suspect?

Police said the suspect, 26-year-old Spencer Olson of Los Gatos, was taken to a hospital and then arrested on burglary charges, the station said.

Police told KTVU the homeowner has been cooperative.

Similar recent incident

Earlier this month police said a husband and wife in their 60s were having breakfast when they heard a knock at the door of their home in Fairfield — about an hour and 20 minutes north of Santa Clara — followed by an attempt to kick down the door after they didn’t respond to the knock.

The husband, fearing for his life and his wife’s safety, grabbed his legally owned gun to defend them, police said.

The intruder then broke down the door completely and entered the residence, police said — after which the husband fired at the intruder, who fled from the home. KTVU-TV reported that police located the intruder collapsed across the street. Police said they detained him and found him in possession of “a loaded semiautomatic handgun with an extended magazine.”

Officers began lifesaving measures until emergency services arrived, but the individual was pronounced dead shortly after 9 a.m., police said.

Authorities said the intruder was a 27-year-old male from nearby Suisun City who was on parole for a violent crime in Alameda County. KTVU reported that the crime for which he was on parole was a home invasion.

“Whatever the motive was, it does not look like it was peaceful or legal,” Fairfield Police Lt. Jausiah Jacobsen told the station. “We know the suspect was armed with a handgun, semi-automatic with magazines. As far as I know, there was no known relationship between the homeowner[s], who are the victims here, and the suspect.”

You Might Have to Pay for Abortions Yet…

0

If the Democrats had their way, abortion would be free and legal to all, no matter the circumstances. But, of course, the only way it can be free is if you are forced to pay for it via your taxes. They’ve been fighting for such to happen for years.

And this week, they’ve gotten closer than ever.

Enter the House Appropriations Committee’s Labor, Health and Human Services, Education, and Related Agencies subcommittee.

On Monday, it passed a spending bill for the Department of Health and Human Services that, if pushed forward, would repeal both the long-controversial Hyde Amendment and its sister, the Weldon Amendment.

If your unfamiliar with these legislative measures, the Hyde Amendment, put in place in 1976, bans federal funds from being used to pay for elective abortions through most healthcare programs like Medicaid.

Similarly, the Weldon Amendment prohibits withholding federal funds from organizations that won’t cover or provide abortions. This was first included as law in 2005.

Basically, as they stand now, these laws mean that you don’t fund the killing of innocent children if you don’t want to and that the government can’t discriminate against facilities or groups that don’t support abortion.

Clearly, the political left doesn’t agree with either law and so would like them abolished.

Now, of course, they claim it’s because the laws have, in recent years, become rather racist, apparently affecting minority women more than whites.

According to Appropriations Committee chairwoman and Connecticut Democratic Representative Rose DeLauro, “(R)egardless of the original intent of Hyde, it has disproportionately impacted women of color, and it has ultimately led to more unintended pregnancies and later riskier, and more costly abortions.”

DeLauro says that “striking this discriminatory amendment” would be “doing what is right” for mothers, families, and communities.

CEO of Planned Parenthood Federation of America Alexis McGill Johnson quite naturally agrees, saying she’s thrilled about the idea of “the racist and sexist Hyde Amendment” being nixed. According to her, it has too long been a way for the government to deny “personal health care” decisions to low-income and minorities.

However, both women seem to be forgetting what democracy is all about, namely the voice of the people.

According to multiple sources, including a Knights of Columbus/Marist poll, most Americans don’t agree with taxpayer-funded abortions, regardless of whether they are pro-choice or not. This means the move to do away with the Hyde and Weldon Amendments is “out of step with the view of most Americans,” as Republican Texas Representative Kay Granger says.

And for a party that claims to be ‘democratic’ and for the people by their very name, that should mean something to most Democrats. However, as American Principles Project president Terry Schilling says, that doesn’t seem to be the case. And that lack of concern for those voices will be their undoing.

“Actions matter far more than rhetoric, and if Democrats continue to act as if the preferences of American voters don’t matter, then they should expect to pay the price for it in the next election. That’s how democracy works, after all.”

But the fact they are ignoring democracy will likely have much more immediate consequences for them if the party continues down this road.

As I mentioned before, the move to do away with these amendments has already passed the subcommittee, meaning a pass from the House Appropriations Committee itself if not too far out of reach. Neither is a win for the Democrats of the House floor if the vote follows party lines.

However, once it reaches the Senate, that’s a different story.

Thanks to the 2020 general election, the Senate is now squarely split down the middle with 50 Democrats and 50 Republicans. However, with the filibuster still fully intact, the Upper House still requires a 60-vote threshold. This means the Democrats will be very unlikely to get the measure passed, even if they can convince typical swing voters like West Virginia’s Senator Joe Manchin to stay on their side.

Therefore, the real question, as Schilling indicated, will be how many of them want to sacrifice their careers in pushing forward a motion that Americans disagree with and will never allow to happen. And boy, won’t that be fun to watch?

Texas Gov Shows Democrats How They Deal With Liars and Lawbreakers

0

Texas Democrats are still Texans. It’s a truth that many struggles with on a daily basis. Much of this anxiety is due to the tenets of the Democrat party running contradictory to the very things that Texans hold dear.

Without boring you with the details you no doubt already know of Texas’s former status as a nation, the fight for independence against Mexico, and the ideology that has risen from the “Friendship” state.

Texas Democrats in the House of Representatives, however, are about to be in for an unfriendly surprise when they get arrested for walking out on their responsibility to vote on a voter integrity law that was before the legislative body this week.

House Republicans, aka, all that was left after Dems staged a walkout, voted to send law enforcement to track down and return their wayward colleagues and come back to vote on the controversial bill, that they didn’t believe they had the votes to stop. Leaving was their only “way out” because of the minimum requirement of representatives needed to hold the vote.

The lawmakers voted 76-4 to issue a “call of the House” that directs the “sergeant at arms, or officers appointed by him, send for all absentees … under warrant of arrest if necessary.” As The Texas Tribune noted, that “The impact of the House move is unclear since Texas law enforcement lacks jurisdiction in the nation’s capital.”

50 of the lawmakers took flight and went to Washington D.C., much like a petulant child who doesn’t want to face a group playing a game they don’t think they can win at.

The group of would-be saboteurs released a statement Monday saying “Today, Texas House Democrats stand united in our decision to break quorum and refuse to let the Republican-led legislature force through dangerous legislation that would trample on Texans’ freedom to vote.

“We are now taking the fight to our nation’s Capital. We are living on borrowed time in Texas. We need Congress to act now to pass the For the People Act and the John Lewis Voting Rights Act to protect Texans — and all Americans — from the Trump Republicans’ nationwide war on democracy.”

This action from Democrats after Texas Gov. Greg Abbott (R) called a special session in an attempt to pass the legislation that Democrats previously blocked in the Texas legislature.

During an interview on Fox News on Monday, Abbott vowed to hold “special session after special session because over time it is going to continue until they step up to vote.” He also warned that the Democrats who left the state would be arrested upon their return, “Once they step back into the state of Texas they will be arrested and brought back to the Texas Capitol and we will be conducting business.”

Texans have been bogged down with the weight of voters from other states moving to Texas looking for lower taxes and a better environment for their families. They have followed that with their appreciation in the form of ushering in the same progressive regimes that made their previous homes untenable.

If behavior depends on its consequences both the liberal voters and the representatives they put into office are likely in for a big surprise and a change in trajectory after Abbott and other Republicans are done with them. Either the state gets straightened out to remain the haven for commerce and freedom so many have come to know and love or America once again gets a front-row seat to what succession looks like.

“Texit” isn’t just an idea, it’s the ace card every member of the Lone Star State carries in their back pocket, knowing that having done it once, it could be done again. And in some cases, possibly must be done.

Whitlock: Gang-of-function mutation terrorizes Washington Nationals Park and America

0

Saturday night in our nation’s capital, gunshots outside Washington Nationals ballpark sent fans inside the stadium scrambling for safety, suspended a Major League Baseball game, and injured three people.

Mainstream corporate media blamed “gun violence.” The more likely culprit is “gang violence.” Police say the shots came from shooters in separate cars firing at each other. Maybe guns were behind the steering wheels and pulling the triggers. It’s more likely gang members drove the cars and aimed the weapons.

As a country, we loathe talking about gang violence … unless we’re glorifying it in music. We prefer to discuss the danger of guns and the evil of the National Rifle Association. I used to do it.

The last time “gun violence” impacted a sporting event, I argued in a column that the Second Amendment had outlived its usefulness. That was in 2012. A linebacker for the Kansas City Chiefs, Jovan Belcher, shot and killed his girlfriend, then drove to the team’s practice facility and shot and killed himself in front of the team’s head coach and general manager.

I wrote a piece for Fox Sports stating what I believed at the time — the proliferation of handguns makes America unsafe. The great broadcaster Bob Costas read an excerpt from my column on NBC’s Sunday Night Football in America.

I’ve never liked guns. I still don’t. But the last decade has helped me understand their value in a free society. A decade ago, I took American freedom for granted. I thought the people who argued that the political left would strip Americans of basic freedoms were crazy. Now I don’t. The government and Big Tech are steadfastly censoring speech they don’t like. They’re dictating medical choices for all of us. They’ve recklessly opened our borders and relaxed immigration restrictions. They’ve undermined respect for and support of law enforcement to the point that many major cities feel lawless.

I live in a very nice, pricey area of midtown Nashville. There have been several shootings, including a murder, within a block of my building.

I’m going to get a gun in 2021. It’s inevitable.

The gatekeepers of American culture, the super elites who live in gated communities and employ private security teams, have purposely created a culture that bows to violent gang culture.

Look at the reaction to what happened at Washington Nationals Park. A fan who left the game to catch an Uber was one of the victims. Gang violence directly impacted the sports world. Are the multimillionaire social activist athletes loudly decrying what happened? Have we heard from Colin Kaepernick or LeBron James? Has Jemele Hill tweeted a word?

They’re all sitting by police scanners waiting for a white cop to shoot another unarmed black resisting criminal suspect. That happens about once a month. Gang shootings happen hourly across America. But you can’t gain Twitter, Instagram, and Facebook followers by taking on the Crips, Bloods, Gangster Disciples, and MS-13.

What you can do is idolize and celebrate the rappers who normalize and celebrate gang culture and gang violence. I’ve long had a love-hate relationship with gangsta rap music. I consider commercial rap fast food, something that I enjoy but know is bad for my health. Dr. Dre is McDonald’s, Tupac Shakur is Popeyes, and Tech N9ne is Wendy’s.

You can’t eat fast food forever. It’s going to kill you.

The glorification of gang culture is killing America. You might think it’s only killing black America. That’s not true.

You have to think of the left-wing gatekeepers, the Hollywood and music executives who finance the promotion of gang culture, the same way as the scientists at the Wuhan lab in China. Gangsta rap is a gang-of-function mutation that escaped the lab and is killing us all. American culture is in crisis. We’ve legalized a lethal dose of immorality, dishonesty, and idolatry. Our code of conduct is driven by popularity, profit, and fear.

It’s safer to demonize guns than gangs. Guns don’t pull triggers. Gangs do.

More Texas Democrats test positive for COVID-19 after fleeing state

0

Two additional Texas House Democrats, who fled the state last Monday to block legislation from passing in the Texas Legislature, have tested positive for COVID-19.

The news comes after the Texas House Democratic Caucus announced Saturday that three caucus members had tested positive for COVID-19.

What are the details?

The Texas House Democratic Caucus announced Sunday that, following three positive tests on Friday and Saturday, the caucus conducted additional testing. As a result, two additional Texas House Democrats tested positive for COVID-19.

That brings the total number of known infections among the caucus to five.

The caucus said in a statement:

In light of some positive COVID-19 tests over the weekend, the House Democratic Caucus has decided to go beyond CDC guidance and provide daily rapid tests for all Members and staff in Washington D.C. for this week. As part of this precautionary testing, today two additional Members who were fully vaccinated tested positive. All of the HDC Members who tested positive are feeling good, with no symptoms or only mild symptoms.

As with the first announcement, the caucus did not disclose the identities of the members who tested positive.

However, Texas State Rep. Trey Martinez Fischer later said that he is one of the infected members and is experiencing mild symptoms. State Rep. Celia Israel also revealed that she tested positive, the New York Post noted.

It was not exactly clear why the caucus has such a high rate of infection. The caucus claims all members are vaccinated, which would make its breakthrough rate significantly higher than what has been seen in the general population. From January through April, for example, only 10,262 breakthrough cases were reported to the Centers for Disease Control and Prevention despite 101 millions Americans being fully vaccinated during the same time period.

According to the Texas Tribune, 56 Texas House Democrats fled to Washington, which would put their current breakthrough rate at nearly 10% — or nearly 1,000 times greater than the general population.

The Texas lawmakers plan to be in Washington for several more weeks.

What about VP Harris?

Texas Democrats were pictured last week gathering in confined spaces without social distancing or face masks.

One of their meetings included Vice President Kamala Harris, who made a surprise trip to Walter Reed National Military Medical Center on Sunday for what her office claimed was a routine medical appointment.

Symone Sanders, senior adviser and chief spokeswoman for Harris, said Saturday that Harris was “not at risk of exposure” during the meeting because she did not come into close contact with the infected House Democrats.

Horowitz: Man accused of killing midshipman’s mom in Annapolis was out of jail on multiple gun charges

0

The media has shoved George Floyd and the names of other career criminals like Rayshard Brooks and Daunte Wright down our throats to the point that nearly every American knows their names. Every American saw the grieving parents who waxed poetic about the police after they raised children who turned into violent criminals. But the stories of black victims of crime like Michelle Cummings that never get told – people who raised their children to be promising leaders and upstanding citizens.

Michelle Cummings and her husband, Leonard, were in Annapolis on June 29 to see their son’s induction into the Naval Academy for the coming year. The Houston couple was looking forward to attending Induction Day and joy for their son, who will play football at the Academy. That joy was cut down when Cummings was killed while sitting on the balcony of her Annapolis hotel room.

Just like the political elites want to blame our justice system for Floyd’s death, Cummings’ death actually represents a much more common flaw in the system – release of career violent criminals on home confinement. Last week, Annapolis police announced the arrest of Angelo Reno Harrod, an Annapolis resident who was allegedly aiming to kill gang rivals but wound up striking Cummings.

Harrod, of course, has a litany of arrests dating back to 2010, and one has to wonder if his record went even further back when he was a juvenile. He has eight prior convictions, including a robbery, pistol whipping a driver of a vehicle over $2 of a fare, and resisting arrest and fighting with officers who wanted to take an illegal firearm away from him.

And in a state where law-abiding citizens cannot carry firearms, Harrod was arrested twice in less than two months on felony gun charges, but was released. According to court documents, Harrod was charged on Feb. 10 with assault and firearm possession and then again on April 12, when he was charged on firearms and drug possession. Yet he was still released on an ankle bracelet to his mother’s home!

Who’s the mother? When prosecutors were describing Harrod’s attempted ambush on two individuals, his mother reportedly blurted out during the bail hearing last Thursday, “Prove it.” Had police successfully shot Harrod before he killed Cummings, his name would have been added to the list of BLM heroes and this mother would have been paraded on TV. She is the antithesis of Michelle Cummings, who raised her kid to join the Navy, but BLM has no regard for her.

Black Lives Matter is built upon a lie. The Marxists promoting that movement only care about black criminals, not the black victims they create through their anti-police and anti-incarceration policies. Home confinement is a joke. Police are being forced to monitor a record number of violent criminals who used to be locked up, and now they have fewer resources. Harrod was able to cut off his bracelet on May 3, yet police were still unable to locate him before the June 29 shooting.

Harrod had two prior convictions for illegal possession of firearms, including those related to robbery. He should have been in prison for life under three strikes and you’re out, but records show he never served time in prison and only served short stints in jail. The Anne Arundel County state’s attorney argued in April that he should have been held without bail, but the liberal judge released him.

Harrod is thus the prototype of the criminals committing all the murders today. The left will wax poetic about guns and police brutality, but nearly every murder, particularly murders of black victims, could have been prevented had we enforced the gun laws against them. Law-abiding citizens in Maryland cannot carry weapons during a period of record crime stemming from the release of people who commit crimes with guns. Maryland is a de facto open carry state, so long as you have a criminal record.

BLM and the bipartisan criminal justice deform leniency-industrial complex that promotes BLM’s policy agenda are telegraphing the message to young black criminals that crime pays. They are creating more and more criminals beginning at a younger age, a trend that is destroying black communities.

According to this Vera report, the U.S. prison population dropped by over 240,000 persons, a little more than 17%, from 2019 to the spring of 2021. Already in 2019, before the precipitous decline from coronavirus jailbreak, according to the Bureau of Justice Statistics, the imprisonment rate of black residents was the lowest rate in 30 years, since 1989. While the left is celebrating this fact and pushing for a much greater reduction, those prison population declines translate into increased spilled blood on the streets. It’s time to recognize that the de-incarceration agenda was a failed experiment and change course.

Republicans would be foolish not to embrace a new agenda for tougher sentencing. This is borne out by the results of a stunning survey from Navigation Research. The poll found that the majority of Americans agree we are in a “state of crisis,” but the public is very divided along partisan lines regarding which issue is a crisis. For example, the overwhelming majority of Democrats believe coronavirus and “climate change” are crises but not Republicans. The opposite is true for the issues of inflation, voter fraud, and China dominance. But there is one exception: violent crime.

The majority of both parties’ voters believe it is a crisis, but most telling, 70% of black respondents – more than any other demographic – believe violent crime is a crisis currently plaguing America. In fact, among black people surveyed, crime was above every other issue except for coronavirus, with which it was virtually tied.

The question for Republicans who have gotten sucked into the Koch-Kushner vortex of de-incarceration in order to shill for the black vote is this: Do they represent families more like the Cummingses or the Harrods?

Britney Spears pens shocking, profane rant regarding conservatorship, says she will no longer perform while her father is in charge

Pop star Britney Spears says she will not perform while under her
father’s conservatorship.

Spears, 39, made the remarks in a
profane Instagram post that had more than 2 million likes and 131,000 comments at the time of this reporting.

What are the details?

The graphic of the post read, “Take me as I am or kiss my a**, eat s***, and step on Legos.”

Spears captioned the viral post, “For those of you who choose to criticize my dancing videos … look I’m not gonna be performing on any stages anytime soon with my dad handling what I wear, say, do, or think!!!! I’ve done that for the past 13 years … I’d much rather share videos YES from my living room instead of onstage in Vegas where some people were so far gone they couldn’t even shake my hand and I ended up getting a contact high from weed all the time … which I didn’t mind but it would have been nice to be able to go to the mother f***ing spa!!!!”

“And no I’m not gonna put on heavy makeup and try try try on stage again and not be able to do the real deal with remixes of my songs for years and begging to put my new music in my show for MY fans … so I quit!!!!” she insisted. “I don’t like that my sister showed up at an awards show and performed MY SONGS to remixes !!!!! My so-called support system hurt me deeply !!!! This conservatorship killed my dreams … so all I have is hope and hope is the only thing in this world that is very hard to kill … yet people still try !!!! I didn’t like the way the documentaries bring up humiliating moments from the past … I’m way past all that and have been for a long time !!!!”

She concluded, “And for women who say it’s weird the way I still have hope for fairy tales … go f*** yourself!!!!! As I said … hope is all I have right now … you’re lucky I post anything at all … if you don’t like what you see, unfollow me !!! People try to kill hope because hope is one of the most vulnerable and fragile things there is !!!! I’m gonna go read a mother f***ing fairy tale now !!!! Psss if you don’t want to see my precious a** dancing in my living room or it’s not up to your standards … go read a f***ing book!!!!!”

In June, Spears delivered an explosive testimony about her 13-year court-appointed conservatorship in late June, which her father Jamie Spears oversees, asking a Los Angeles Superior Court judge to end the conservatorship.

Jamie placed Britney under the conservatorship in 2008 after she suffered what were reportedly several very public nervous breakdowns.

A June report revealed that the conservatorship “restricted everything from whom she dated to the color of her kitchen cabinets.”

Jamie, now co-conservator of his daughter, reportedly receives a monthly salary of $16,000 for his role as ward over Spears’ personal and professional life.

In July, a judge denied Spears’ request to remove her father as co-conservator.

The case is set to continue in September.

Deace: This energy and dedication are what we need – so that we don’t let America perish on our watch

“I look forward to hearing from you and hope we can work together to get off the bench and into the battlefield.”

Say no more, Abby White.

Because in a world where a 14-year-old girl signs her letter to me that way while David French is busy making the “conservative case” for critical racist theory and drag queen story hour, I know without any ambiguity whatsoever whom I am picking for my team at recess, let alone when the fighting starts.

Abby is like me in that she is utterly fed up with the lying. She desperately wants to let the lion of truth out of its cage. She believes the actual and manifold blessings of liberty in the grand American tale are more than enough to provide the appropriate context for the sins of the past, the ongoing problems of the present, and passing the torch of citizenship to our children and grandchildren in the future.

She understands, as Samwise did at the end of “The Two Towers,” that there is good in this world and it is worth fighting for.

So you are dang right I’m going to help her.

“I am homeschooled and have learned a lot about American History,” she said. “I was wondering if you could help me. I am so frustrated because I love America and I love American history and I am finding that my friends (even homeschooled friends) and my church friends do not know anything about American History and what people went through to give us the freedom we have today! I have been listening to you talk about getting off the bench and into the battlefield. I want to do that! I have an idea but I need some help. I love the CD put out by Home School Legal Defense Association and Focus on the Family on American History. It goes through some very important parts of our history that would help kids and (maybe parents) learn how special our country is. I would like to order 1,000 copies of this CD and get it out to school kids. This could really help stop the effort to put critical race theory in schools. We have to STOP this!! Kids are learning the opposite of what is true. They are being told our country is not special and is racist and hateful. We are an amazing country and if we all stand together and tell the kids growing up today that America is an amazing place, maybe just maybe we can make a change.

“My first goal is to raise $10,000 to buy 500 CDs and give them to my friends at church. I know that sounds crazy, but even my friends at church don’t know much about the history of America and how proud and excited we should be to live in this great country.”

Nothing about that sounds crazy, Abby. But it does sound familiar. It sounds like Sam Adams. It sounds like Thomas Jefferson. It sounds like Patrick Henry. It sounds like the words of the great founders of our nation who knew exactly what was at stake and why heaven itself, via the laws of nature and nature’s God, was to be the compass and shield for carrying out the fight for true liberty.

Abby, like her nation at its creation, is a shining city on a hill. Shame on us if we hide her passion under a bushel basket. Shame on us if we allow her to stand alone.

This teenage girl is showing more desire and want-to than the pathetic case study in passive-aggression we see from legions of boys who can shave these days. It is this kind of grassroots energy and dedication that are required so that we don’t let this nation perish on our watch.

It takes a lot of chutzpah for a 14-year-old to even think this is possible, let alone believe she can get it on the radar of a national media platform and ask for help. And that’s a lot more chutzpah than we’ve seen the last year from a generation of adults in this country who spent too much time complying with wearing a useless Chinese face diaper with barely a hint of resistance.

So you’re dang skippy I’m going to give gutsy Abby some publicity and help her spread the message. And if you’d like to do the same, hit up her Venmo @Joy-White-55.

Biden Expresses Disappointment Over Judge’s DACA Ruling

0

Federal Judge Andrew Hanen of the U.S District Court in Houston recently ruled for the Biden Administration to stop all applications for the Deferred Action for Childhood Arrivals (DACA) program and ruled that the Obama-era program was illegal, to begin with. This will be a huge blow to the Biden Administration and their promise to protect this illegal program. It is also the first time a court has ruled that the program is illegal.

Hanen found that the Department of Homeland Security violated the Administrative Procedure Act (APA) in creating the policy and implementing it. He said that the program usurps the power of Congress to dictate a national scheme of immigration laws. While they will continue to accept applications, none will be approved at the time. The change does not affect current DACA recipients and those receiving benefits from the program.

President Biden said he was incredibly disappointed by the federal judge’s ruling and that they intend to file an appeal and publish a proposed rule about the program. While he signed a memo to protect DACA and give a path to citizenship for all illegal immigrants, he renewed his calls.

Biden said he repeatedly called on Congress to pass the American Dream and Promise Act to provide security to all dreamers and those who “have lived too long in fear.” He said that the Obama-Biden administration created the program to let hundreds of thousands of young immigrants remain in the United States.

But many states have been attempting to sue and halt DACA for quite some time now. Texas argued that former President Barack Obama lacked the power to create the program in the first place. They also said that the DACA policy violated the Constitution. Obama argued back in his own tweet.

“For more than nine years, DREAMers have watched courts and politicians debate whether they’ll be allowed to stay in the only country many of them have ever known. It’s long past time for Congress to act and give them the protection and certainty they deserve,” Obama wrote.

Judge Hanen shared that Obama’s executive order didn’t allow the public to comment and engage in the “statutorily mandated process.” He said that DACA never gained status as a legally binding policy that could impose duties or obligations.

The Obama Administration has a history of ignoring the APA when issuing rules and seemed to ignore this one when they granted 700,000 illegal immigrants protected under the program and a hundred thousand more illegal immigrants deemed eligible for it. The program would also grant work authorization and lawful presence to over a million illegal aliens whom Congress made no laws about.

Strangely enough, former President Donald Trump dealt with the opposite problems. He made multiple moves in 2017 to end the program but a federal judge in Brooklyn, New York ordered the Trump Administration to reinstate it. Critics argued that the numerous court rulings have led to little to no legislative progress over immigration reform in the past decade.

Biden now has an uphill battle before the Supreme Court. But he should know by now that looking for ways to break the Constitution to push DACA through is also against the Constitution.

Major American cities are facing a homelessness crisis and Biden has it in his mind to provide citizenship to millions of illegal immigrants. At least a federal court is actually interpreting federal law and the Constitution for once. This is a ruling in favor of the law, not the Democratic Party.
